Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of elnesclinic.ca (the “website”), to the services provided by Elnes Clinic (“Elnes Clinic”, “we”, “us” or “our”) at 3355 Yonge Street, Toronto, Ontario, and to the text messages we send. By using the website, booking an appointment or opting in to text messages, you agree to these Terms. Please also read our Privacy Policy.

1. Information on this website

The content on this website is general information about our clinic and the treatments we offer. It is not medical advice and does not replace a consultation with a qualified professional. Whether a treatment is suitable for you can only be decided after a consultation and a review of your medical history.

2. Consultations and treatment

• Every treatment begins with a consultation and a review of your medical history. We may decline to treat you if a treatment is not suitable or safe for you.
• You agree to give us complete and accurate information about your health, medications and medical history, and to tell us about any changes.
• You will be asked to sign an informed consent form before treatment. Results vary from person to person and are not guaranteed.
• Our services are available only to adults aged 18 and over.

3. Appointments, cancellations and packages

• Appointments booked online, by phone or by text are confirmed once you receive a confirmation from us.
• If you need to cancel or reschedule, please let us know as early as possible so we can offer the time to someone else.
• Prices, package contents, payment terms and any cancellation or refund conditions are confirmed to you in writing before you commit to a treatment or package. Those written terms form part of your agreement with us.
• Prices are in Canadian dollars and are subject to applicable taxes.

4. Text messaging (SMS) terms

Program. Elnes Clinic text messages. When you opt in, we send text messages about your enquiries and appointments, including appointment confirmations and reminders, rescheduling notices and replies to your questions. If you also opt in to marketing messages, we may send occasional messages about our treatments and offers.

How you opt in. You agree to receive text messages by ticking the consent box on a website form or booking page, by texting us first, or by agreeing in person at the clinic. Consent to receive text messages is not a condition of purchasing any service.

Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.

Please do not send sensitive medical information by text message. We will discuss your health privately at your appointment.

5. Email and other electronic messages

We send commercial electronic messages only with your consent, in line with Canada’s Anti-Spam Legislation (CASL). Every marketing email includes our contact details and a way to unsubscribe, and we act on unsubscribe requests within 10 business days.

6. Use of the website

You agree to use the website only for lawful purposes. You must not interfere with the website, try to gain unauthorised access to it, or use it to send unsolicited messages. All content on the website, including text, images, logos and design, belongs to Elnes Clinic or its licensors and may not be copied or reused without our written permission. EMSELLA® and Venus Bliss MAX™ are trademarks of their respective owners.

7. Third-party links and tools

The website may link to or embed third-party websites and tools, such as maps, booking calendars and social media. We are not responsible for the content or privacy practices of those third parties.

8. Limitation of liability

We work to keep the website accurate and available, but it is provided “as is” and we do not guarantee that it will always be available, error-free or up to date. To the extent permitted by law, Elnes Clinic is not liable for any indirect or consequential loss arising from your use of the website. Nothing in these Terms limits any rights you have under applicable consumer protection law, or our responsibilities for the care we provide.

9. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

10. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they last changed. If you continue to use the website or our text messaging service after changes are posted, you accept the updated Terms.
